Legal and Technical Verification in a Housing Loan: What Lenders Check

Legal and technical verification are the two property checks a lender completes before disbursal. Legal verification tests title and approvals, and technical verification tests value and construction, so a lower valuation cuts your loan.

Understanding Legal and Technical Verification in Home Loans

Last updated: Oct 2026

Legal and technical verification protect the lender's security before money is released. They test two different things. Legal verification tests who owns the property, and technical verification tests what it is worth.

  • Legal check: title chain, encumbrances, approvals and registration
  • Technical check: valuation, construction stage and match with the sanctioned plan
  • Loan limit: the lender lends on the lower of the agreement price and the valuation
  • Example: a Rs. 80 lakh price valued at Rs. 74 lakh cuts the loan from Rs. 64 lakh to Rs. 59.2 lakh
  • Your protection: the lender's legal opinion serves the lender, so a lawyer of your own protects you

Collect the title papers and approvals before you apply, and ask the seller to fix any gap early. Hire your own lawyer, because the lender's check does not cover your risk.

What is legal and technical verification in a housing loan?

Legal and technical verification are the two checks a lender completes on a property before it releases a housing loan. The property is the lender's security, so the lender confirms that it is legally clean and worth the loan.

The lender appoints professionals for both. A lawyer reviews the papers, and a valuer or engineer inspects the property. You supply the documents and give access to the site.

What does the legal check cover?

The legal check confirms that the seller can sell, that nobody else holds a claim and that the construction is lawful. It reads documents, not the building.

CheckWhat it confirmsDocument
Title chainThe seller owns the property and can transfer itPrevious sale deeds, title deed
EncumbrancesNo loan or claim is registeredEncumbrance certificate
ApprovalsThe construction is lawfulSanctioned building plan, occupancy certificate
Project registrationThe builder is registeredRegistration number under the Real Estate (Regulation and Development) Act (RERA)
Society consentThe transfer is permittedSociety no-objection certificate, share certificate
DuesNo unpaid chargesProperty tax receipt, maintenance no-dues letter

What does the technical check cover?

The technical check confirms what the property is worth and how much of it exists. A valuer visits the site, measures it and compares the findings with the agreement.

CheckWhat it confirms
ValuationThe market value used to size the loan
Construction stageFor an under-construction flat, the progress that supports each payment
Match with the planThe built area and layout agree with the sanctioned plan and agreement
ConditionThe structure and finish suit the stated age
LocationThe address and access match the documents

For an under-construction project, the lender releases money in stages after it verifies progress on site.

How does a lower valuation change my loan?

A lower valuation shrinks the loan, and you fund the gap. The lender lends the loan-to-value (LTV) percentage on the lower of the agreement price and its valuation.

Formula used: Loan = LTV × lower of (agreement price, valuation). For loans of Rs. 30 lakh to Rs. 75 lakh, the Reserve Bank of India caps LTV at 80% (circular of 8 October 2015).

ItemIf valued at the priceIf valued lower
Agreement priceRs. 80,00,000Rs. 80,00,000
ValuationRs. 80,00,000Rs. 74,00,000
Loan at 80%Rs. 64,00,000Rs. 59,20,000
Cash you fundRs. 16,00,000Rs. 20,80,000
Extra cash neededRs. 0Rs. 4,80,000

Trade-off: you can negotiate the price down using the valuer's figure, or you can fund the gap. Decide before you pay a token amount.

What causes verification to fail or slow down?

Most delays come from a missing document, not from a bad property. Six problems cause the queries below, and each has a fix.

ProblemWhat it meansFix
Break in the title chainA prior sale deed is missingSeller obtains a certified copy
Unapproved constructionThe building exceeds the sanctioned planSeller seeks regularisation from the local body
Builder not registeredThe project has no RERA numberWait for registration or choose another project

How do I prepare for the property checks?

Six steps shorten the wait.

  1. Ask the seller for the full document set before you pay a token amount.
  2. Check the RERA registration of any new project on the state portal.
  3. Obtain the encumbrance certificate and the property tax receipt.
  4. For a flat in a society, collect the no-objection certificate and the no-dues letter.
  5. Give the valuer access on the agreed date, with the plan in hand.
  6. Answer every query in writing and keep copies.

Hire your own property lawyer in parallel. The lender's legal opinion protects the lender's security, and it does not protect your purchase.

A worked example: Rs. 74 lakh valuation, Rs. 80 lakh flat

Consider Sunil, a 39-year-old marketing manager in Thane with a household income of Rs. 1.9 lakh a month and a CIBIL Score of 756, buying an Rs. 80 lakh resale flat.

Formula used: Loan = 80% × Rs. 74,00,000. Share of income = Equated Monthly Instalment (EMI) ÷ monthly income.

ItemAmount
Loan after valuationRs. 59,20,000
EMI at 8.50% p.a. for 20 yearsRs. 51,375
EMI as a share of income27.0%
Extra cash Sunil must fundRs. 4,80,000

Sunil uses the valuation report to negotiate Rs. 3 lakh off the price. His legal and technical verification then clears. Read the full buying sequence in the guide to how to buy your dream home.

Frequently Asked Questions

The process

Cost and protection

Who carries out the checks?

The lender appoints professionals. A lawyer reviews the title papers and approvals, and a valuer or engineer inspects the property and measures it. You do not choose them, but you supply the documents and give access to the site. If a query arises, ask for it in writing, so you know exactly which paper or fix is needed.

What happens if the valuation is lower than the price?

The loan shrinks, because the lender lends on the lower figure. On an Rs. 80 lakh flat valued at Rs. 74 lakh, the loan falls from Rs. 64 lakh to Rs. 59.2 lakh. You can fund the Rs. 4.8 lakh gap or use the valuer's figure to negotiate the price. Decide before you pay a token amount.

Does the lender's legal check protect me as the buyer?

No. The lender's lawyer checks that its security is sound, and the opinion is addressed to the lender. A defect that does not threaten the lender's security may still hurt you. Hire a property lawyer of your own to read the title chain, the approvals and the sale agreement before you sign.

Who pays for the checks?

Read the lender's fee schedule and your sanction letter before you pay anything. Bajaj Finance publishes its charges on the fees and charges page. Ask for a receipt for each charge, and confirm in writing whether any legal or technical charge is included in the processing fee or billed separately.
