article1

Form 61A, also known as the Statement of Financial Transactions (SFT), is a mandatory reporting document under Indian tax laws. It is used by specified entities to report high-value transactions, such as large deposits or property purchases, ensuring transparency and compliance with the Income Tax Department's regulations.

Key takeaways:

  • Purpose: Form 61A is used to report high-value financial transactions.
  • Mandatory filing: Required for banks, financial institutions, property registrars, and other entities.
  • Transactions covered: Includes cash deposits, property sales, credit card payments, and fixed deposits exceeding threshold limits.
  • Penalty for non-compliance: Delayed filing attracts daily penalties under Section 234E.
  • Nil Statement: Must be filed even if no reportable transactions occur.

What are specified financial transactions?

Specified financial transactions (SFTs) are high-value financial activities that entities are required to report to the Income Tax Department under Form 61A. These transactions aim to promote transparency and prevent tax evasion.

Examples of specified financial transactions:

  • Large cash deposits or withdrawals: Cash transactions exceeding Rs. 10 lakh in savings accounts during a financial year.
  • Fixed deposits: Fixed deposit investments exceeding Rs. 10 lakh in a single financial year.
  • Credit card payments: Payments exceeding Rs. 1 lakh in cash or Rs. 10 lakh through other modes annually.
  • Property purchases or sales: Transactions where the value exceeds Rs. 30 lakh.
  • Mutual funds or bonds: Investments in mutual funds, debentures, or bonds exceeding Rs. 10 lakh.
  • Foreign exchange transactions: Expenses or purchases exceeding Rs. 10 lakh in a financial year.

These transactions are reported to ensure tax compliance and reduce the risk of undisclosed income or assets. Entities failing to report these transactions may face penalties under the Income Tax Act.

Last date for filing Form 61A

Form 61A, also known as the Statement of Financial Transactions (SFT), must be submitted by May 31st of the financial year immediately following the year in which the transaction occurred. For instance, transactions recorded in the financial year 2023-24 should be reported by May 31, 2024. Timely filing is crucial to avoid penalties under Section 271FA of the Income Tax Act, which imposes a fine of Rs. 500 per day for delays.

Who is required to submit Form 61A

  • Banks and financial institutions: Required to report high-value transactions, such as large cash deposits or withdrawals.
  • Property registrars: Must report property transactions exceeding Rs. 30 lakh.
  • Mutual fund companies and NBFCs: Report investments or transactions above specified thresholds.
  • Credit card issuers: Submit details of high-value payments.

Transactions to be reported in Form 61A

Form 61A, also known as the Statement of Financial Transactions (SFT), is used to report specified high-value transactions to the Income Tax Department. These transactions ensure transparency in financial dealings and compliance with tax regulations.

Transaction Type

Threshold

Cash deposits/withdrawals in savings accounts

Exceeding Rs. 10 lakh in a financial year

Fixed deposits

Exceeding Rs. 10 lakh in a financial year

Credit card payments

Exceeding Rs. 1 lakh in cash or Rs. 10 lakh by other modes annually

Property purchases/sales

Transactions exceeding Rs. 30 lakh

Mutual fund investments

Exceeding Rs. 10 lakh in a financial year

Foreign exchange transactions

Exceeding Rs. 10 lakh in a financial year

Accurate reporting of these transactions ensures compliance with the Income Tax Act and prevents potential penalties.

Filing of Nil Statement

Filing a Nil Statement for Form 61A is mandatory if a reporting entity has no specified financial transactions during a financial year. Even in the absence of reportable transactions, the Income Tax Department requires entities to file this statement as a declaration of compliance. It ensures that the entity fulfils its obligation under Section 285BA of the Income Tax Act. Failure to file a Nil Statement may attract penalties, making it important for entities to file Form 61A within the stipulated deadline, even if there are no transactions to report.

Filing of Statement of Financial Transactions (SFT) online

Follow these steps to file the SFT (Form 61A) online:

  1. Log in to the Reporting Portal: Access the Income Tax Department's Reporting Entity portal using your credentials.
  2. Select Form 61A: Choose the Statement of Financial Transactions (Form 61A) from the available forms.
  3. Prepare the statement: Use the prescribed utility tool to input details of reportable transactions.
  4. Upload the file: Convert the completed statement into the required file format (XML) and upload it on the portal.
  5. Submit and verify: Verify the submission using a Digital Signature Certificate (DSC).
  6. Track status: Monitor the submission status on the portal to ensure successful filing.

Filing Form 61A online streamlines compliance and ensures timely reporting.

Different parts of Form 61A

  • Part A: General information about the reporting entity, including name, PAN, and reporting year.
  • Part B: Details of financial transactions reported, including type and value.
  • Part C: Summary of transactions categorized by type and threshold limits.
  • Verification: Declaration ensuring accuracy and compliance.

Rules for aggregation

  • Single transaction limit: Transactions are aggregated if they individually exceed the specified threshold.
  • Multiple transactions: Multiple transactions of the same nature with a single person are aggregated for the financial year.
  • Account-based aggregation: Transactions in a single account are combined to determine reporting eligibility.
  • Entity-specific rules: Aggregation rules depend on the reporting entity and transaction type.

Conclusion

Form 61A is a crucial compliance document for reporting specified high-value transactions to the Income Tax Department. Filing it accurately and on time ensures adherence to tax regulations, avoids penalties, and promotes financial transparency. Both reporting entities and the government benefit from the structured monitoring of financial activities.
