Understanding Section 139AA of the Income Tax Act: PAN and Aadhaar Linking Explained

Under Section 139AA of the Income-tax Act, 1961, anyone who has been issued a Permanent Account Number (PAN) must link it with their Aadhaar. This requirement is mandated for all PAN holders to ensure compliance with tax regulations.

Section 139AA of Income Tax Act 1691 says that if you are an individual who has been allotted a PAN card or a Permanent Account Number, you are also required to link the same to your Aadhaar Card. The Government of India has been urging people to link their Aadhaar cards with their PAN cards. As part of its efforts to create a digitised and unified tax system, the Finance Act 2017 amended the Income Tax Act, 1961, by introducing Section 139AA. This section requires you to link your Aadhaar card with your PAN card, making it mandatory to provide your Aadhaar details when filing your Income Tax Returns (ITRs).

What is Section 139AA?

Section 139AA of Income Tax Act 1961 had been introduced by the Finance Act of 2017, mandating the linking of your Aadhaar with your PAN. The Section 139AA has been effective since 1 July 2017, and made it mandatory for you as a taxpayer to link your Aadhaar with your PAN to be able to file your ITRs.
 

Section 139AA also lays down certain consequences if you do not link your Aadhaar with your PAN. If you fail to link your Aadhaar card to your PAN, your PAN would be considered invalid. This means you would not be able to use your PAN for any financial transactions, including filing ITRs, if it is not linked to your Aadhaar.
 

However, there are exemptions in certain cases. If you are not eligible to obtain an Aadhaar number, you can link your PAN using the enrollment ID issued when you applied for Aadhaar. Additionally, if you do not have an Aadhaar number or enrollment ID, you can still file your ITR by providing your Aadhaar enrollment number or Aadhaar ID application number.

Linking your Aadhaar with your PAN is an important step towards creating a digitised and unified tax system in India. By linking these two documents, you help the government eliminate duplicate PANs, which in turn helps in identifying fraudulent practices.   • Rates specified in the provision of the Act that is relevant, or

  • At the rate in force or

  • At the rate of 20%

Impact of Section 139AA

Effective from July 1, 2017, you are required to provide your Aadhaar number or at least your Aadhaar enrolment number when filing income tax returns or applying for a PAN card. If you do not yet have an Aadhaar, you will need to apply for one within the next 20 days if you plan to file returns after July 1, 2017. If you wish to file returns or apply for a PAN before this deadline, you can do so without an Aadhaar for now.

According to media reports, the Central Board of Direct Taxes (CBDT) has carefully considered the court's decision on the Aadhaar linkage issue. Here's what you need to know about the impact of Section 139AA:

  • The CBDT has clarified that the Supreme Court has provided only 'partial relief' to those without an Aadhaar or enrolment ID, meaning your PAN will not be cancelled if you do not have Aadhaar yet.

  • Only a small number of taxpayers will be impacted by Section 139AA. If you fall into this group, you can still file your income tax returns without mentioning an Aadhaar number up to June 30, 2017.

Exceptions and exemptions

You are exempt from the requirement to link your Aadhaar with your PAN under certain circumstances. These exceptions are designed to simplify the process and ensure that those who have already complied with the requirement or are not obligated to do so are not burdened with unnecessary steps. The government has exempted certain groups, including:

  • Non-resident Indians (NRIs)

  • Persons with disabilities

  • Minors under 18 years

  • Residents of Assam, Jammu and Kashmir, and Meghalaya

If you fall into any of these categories, you are not required to link your Aadhaar or Enrolment ID with your PAN or income tax filings.

Things to remember

Here are some things to remember with respect to Section 139AA:

  • If you are eligible to obtain an Aadhaar number, you must, starting from 1st July 2017, quote your Aadhaar number in the application form for a Permanent Account Number (PAN) and in your income tax return. If you do not have an Aadhaar number, you can use the Enrolment ID provided at the time of your Aadhaar application.

  • If you already have a PAN as of 1st July 2017 and are eligible for Aadhaar, you must inform the relevant authority of your Aadhaar number by a date specified by the Central Government. Failure to do so will render your PAN invalid, and it will be treated as though you never applied for it.

  • Certain individuals or groups, as notified by the Central Government, may be exempt from these requirements. The terms "Aadhaar number," "Enrolment," and "resident" are defined as per the Aadhaar Act, 2016, with the Enrolment ID being a 28-digit number issued during Aadhaar enrollment.
